Kosieradzki Smith Law Firm Case Featured in New York Daily News

By Kosieradzki Smith Law Firm / February 24, 2014

The Kosieradzki Smith Law Firm Case has not only been featured in numerous Minnesota news articles, including front page of the Minneapolis Star Tribune, but has also made the New York Daily News. Nurse Examiner Theresa Flesvig is featured on her side of the story about 29-year-old Andrew Merzwski raping an 88-year-old woman at Edgewood Vista Senior Living.

flirt24n-2-webAndrew Merzwski, a nursing aid at Edgewood Vista, was sentenced to more than four years in prison for sexually assaulting Kosieradzki Smith’s client. To make matters worse, the facility defended Merzwski, saying the victim was a “flirt” and teased Merzwski “mercilessly.”

The nursing home supervisor, Marilyn Moore, said to Theresa Flesvig, who inspected the victim, “Did she tell you this was consensual?” The supervisor also went as far as to say, “Did she tell you that she flirts with this boy mercilessly?”

After the attack took place the victim was forced into a psychiatric ward at St. Luke’s Hospital. She spent nearly three days in a cold room as investigators checked out her story. “The room was dark and cold…and they locked her in at night and all she had was a blanket,” Flesvig testified.

Flesvig was stunned when she heard Moore describe the woman as a flirt and suggest the sex was “consensual.” This not only outraged the victim and her family, but has also outraged many citizens after hearing this horrific story of neglect by the facility administrators.

People took their thoughts to the internet as this story has been shared over 5,000 times on Facebook alone.BLOGFB

“I was just shocked that somebody was so blatantly putting the blame on this woman,” Flesvig testified.
